  Terms & Conditions Starfish Vacation Rentals

Rental agreement required to confirm and secure booking. Any monies received by Starfish Vacation Rentals for occupancy of vacation property indicates the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.  Thanks for your business and we hope you enjoy your stay in our property!


Named Renter/Primary Guest: For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the primary Guest/named Renter. All other persons involved with the rental are considered to be the Guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the Guest, not the guest's invitees. Named Renter must be residing in the unit during the reservation. Reservations made under false pretenses are subject to cancellation and/or eviction with forfeiture of all funds paid. 

Guests Obligations: include but are not limited to - keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses.  Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation.  Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of Guest occupancy with no refund of any kind.

Payment: Final payment will REQUIRED 30 days prior to checking-in to your vacation rental.

Upon Arrival: If there are concerns or issues with your Rental Property, please immediately reach out to notify us with pictures via text or email. If there is an issue with housekeeping, we will send housekeeping back to correct the problem as soon as possible. No refunds or cancellations given for problems that are promptly addressed or for ANY issue that is not reported to us within 24 hours of check in. 

Arrival Time: Check in time is anytime after 4pm. Please do not arrive at the property before your scheduled check in time.

Departure Time: Check out is anytime before 10am. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests. Failure to check out by the designated check out time of 10am WILL result in an additional night's rent being charged. Failure to follow check out instructions will result in additional charges.

Check Out Instructions: The Rental Property will be cleaned before your arrival and after your departure. There is no daily cleaning service provided or offered. You are required to leave the Rental Property in the same general condition in which you received it. 

  1. Make sure that front door keys are returned to the lockbox (if applicable) and any amenities key cards/key fobs/keys and/or garage door remotes (if applicable) are returned to the kitchen counter. A $100 replacement fee per item will apply if not returned;
  2. Leave sheets on the beds and dirty towels in piles in the bathrooms. Do not wash the linens;
  3. Wash all dishes and put away before departure. Leave ALL kitchen items (dishes, cookware, etc.) clean and dishwasher running. Additional cleaning chargers will apply if any kitchen items are left dirty.
  4. Dispose of ALL trash in proper outside containers. Additional cleaning charges will apply if any trash is left inside the property. If you need help locating the trash chute/garbage can/dumpster, please reach out to us. 
  5. DOUBLE CHECK that ALL doors and windows are closed and locked. Lock all doors (including balcony, if applicable) and windows. If keyless lock on front door, make sure it locks itself when you close it. Some digital locks may require you to press a lock button or the logo button. 
  6. Please make sure that all personal belongings have been removed from the unit. Clothes, electronic devices, chargers etc. Double check in closets, drawers, outlets, under beds. SVR is not responsible for any items left behind.

WHAT WE SUPPLY: The Rental Property is fully furnished and includes bedspreads, linens, blankets, pillows, towels, equipped kitchen. The condo is re-provisioned each year at the beginning of the rental season; however, we make no guarantee that all items will remain in the condo during your rental. Please contact us if you feel something is missing that should be there. ONE STARTER ROUND IS PROVIDED - consisting of 1 roll of toilet paper, 1 face soap bar, 1 body soap bar per bathroom; 1 roll of paper towels,1 travel sized dish soap bottle, 1 trash bag per trash can, single load pack of dishwashing detergent, and single load pack of laundry detergent is provided; please plan to bring or purchase extras. These items are not replenished during your stay.

WHAT YOU SHOULD BRING: Please bring your personal toiletry items including hair dryers, beach towels, as well as food, trash bags, spices, coffee, and any other consumables. Please bring extra incidental supplies needed, based on the information in the paragraph prior.  


Cancellation Policy: 

  • Guests who cancel at least 30 days before check-in will receive what that have paid MINUS $100 cancellation fee and the $75 nonrefundable reservation fee. ( Deposit - $175 = refund total )

  • If Guests cancels within 30 days of check-in, they'll receive 50% of the amount they've paid, MINUS $100 cancellation fee and the $75 nonrefundable reservation fee. 

  • Cancellations made less than 14 days prior to check-in will receive no refund. 

It is HIGHLY ENCOURAGED that guests purchase travel insurance.

Reservation Payments: If the booking is made more than 30 days in advance of the arrival date, a payment of 50% is taken by SVR at the time of the booking.  Any remaining balance must be paid 30 days prior to the arrival date, or this Agreement may be cancelled by the sole option of the Owner and all deposit funds forfeited. Final payment will be required prior to checking-in to your vacation rental. All policies contained in this Agreement shall apply equally to payments made by credit card whether made via website or by phone. Any refunds due to Guests from a credit card payment will be refunded by credit card transaction. Regular payments for the booking will be displayed as Starfish Vacation Rentals on the Guest's credit card statement.

Refund Policy: No refunds will be provided due to inoperable appliances, pools, hot tubs, elevators, unavailable amenities, maintenance visits, etc.  The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order.  No refunds will be given due to power blackouts, water shortage, flooding, inclement weather, construction at adjacent properties, early departure due to personal circumstances or voluntary evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of God or nature. However, if there is a Mandatory Evacuation ordered by local authorities due to a hurricane, all unused rents while the evacuation order is in effect will be refunded.

NON PET FRIENDLY UNITS: Pets are not allowed. Any evidence of pet(s) found in or about the Rental Property during the Guest’s stay will be grounds for expedited eviction and forfeiture of all monies paid. Evidence of pets after the Guest checkout will result in a $500 fine, charged to the credit card on file.

PET FRIENDLY UNITS: a nonrefundable pet fee of $150 must be paid prior to bring your pet. Cats are not allowed in any unit. Any evidence of a cat during the Guest's stay will be grounds for expedited eviction and forfeiture of all monies paid. Any evidence of a cat after the Guest checkouts will result in a $500 fine, charged to the credit card on file. No more than the max allowed stated in the unit information, you will risk eviction and losing all funds. 

ABSOLUTELY NO SMOKING: Smoking in or about the Rental Property is strictly prohibited. Evidence of smoking or lingering smoke smell in a unit will result in a $500 fine. Smoking is not permitted on balconies- please go to the ground flor away from other guest to smoke.

Parking: 2 cars is the limit. There are no exceptions to these policies put in place by the HOA's. It is the guests responsibility to research for alternate arrangements for any and all vehicles that go over the max allowed. NO boats, jet skis, trailers or RVs. Prices of Parking Passes are subject to change. Parking Pass limits allocated for Rental Properties are subject to change.

Occupancy/Disturbances: In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the web site. No parties, events, wedding receptions, etc., are allowed. In no event shall Guests assign or sublet the Rental Property in whole or in part. Guest must abide by quiet hours posted on premises at each rental property, if applicable. Violations of these rules are grounds for expedited eviction with no refund of any kind.
If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premises without any refund and additional charges may be assessed.


Pool/Patio: Guest hereby acknowledges that the premises they have reserved may include a pool and the undersigned agrees and acknowledges that the pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Guest accepts and assumes all risks involved to Guest and all of Guest's guests in or related to the use of the community pool and patio areas.

Maintenance: Report all maintenance issues promptly. Just as might occur at your own well-maintained home, mechanical failures and other breakdowns could occur. Every effort will be made to correct the situation; however, no refunds or rate adjustments will be made for mechanical failures. Maintenance technicians and vendors may access the property for purposes of repairing previously reported issues.

Damages: As a condition to the rental of all vacation properties, Starfish Vacation Rentals reserves the right to charge the Guest's credit card for any and all uncovered Guest/invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy. In the event of any uncovered Guest/invitee-caused loss or damage to the vacation property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, Starfish Vacation Rentals is hereby granted the right to charge the guest's credit card. By written or electronic endorsement of this agreement, the guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages. Owner is under no obligation to use the least expensive means of restoration. Please note any damages to the Rental Property upon your arrival and report it in writing immediately to avoid possible liability. Please notify us immediately of any loss or damage occurring during your stay.

Property Availability: In the event Owner is unable to make Rental Property available for any reason or a reasonable substitute as determined by Owner, Guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability.

Entry By Owner: Guest(s) agree that Starfish Vacation Rentals reserves the right to enter the Rental Property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate. Owner or Owner's Agents may enter the premises under the following circumstances: in case of an emergency; to make any necessary or agreed upon repairs, alterations, or improvements; supply necessary or agreed upon services or show the premises to prospective purchasers, renters or contractors. Owner will try to provide renter with at least 24 hours’ notice of Owners intent to enter (except in the case of an emergency).

Hurricane/Named Storm Policy:  In the event that a MANDATORY EVACUATION order is issued for our area, we will require guests to depart and will issue a prorated refund for any unused nights rents. Any guest choosing to stay agrees to hold SVR harmless from liability for any loss or damages to personal property that may occur and/or any bodily injury (including death) that may occur. In the event that our local area is directly hit by a hurricane, resulting in our properties becoming uninhabitable or city closures, we reserve the right to take up to (30) days to process full refunds for reservations that must be cancelled. During this (30) day period, we make no guarantee that we will be able to promptly respond via text, call, or email due to the potential loss of power, internet service, and cell phone service as well as the personal impact that may occur to our staff and employees who reside locally. 

Emergencies/Maintenance: In the event of a problem getting in the vacation rental or if there are problems with condition or functionality of the vacation rental, please immediately contact the sStarfish Vacation Rentals office (leave a voice message if there is no answer!) at 251-948-2118. If it is after office hours we will make every effort to return your call as soon as possible.

Plumbing/Garbage Disposal: Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease, egg shells, shrimp peel, sand, rice etc. down the drain or garbage disposal. Service call costs incurred due to improper use will be charged to guest. 

Security/Safety Risks: Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the vacation rental. Starfish Vacation Rentals does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. 

Indemnification & Hold Harmless: While Starfish Vacation Rentals and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the vacation property structures and premises at their own risk. Starfish Vacation Rentals and its Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Starfish Vacation Rentals and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify Starfish Vacation Rentals and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.

Additional Terms and Conditions: The undersigned Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all liabilities, claims, demands, and causes of action by reason of any injury, loss of damage by whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorney's fees and costs. You also agree to be responsible for and reimburse the property Owner for any applicable costs and attorney's fees incurred for collection of damage. Neither {MYCOFULL} nor the Owner will be responsible for accidents or injury to guest or loss of money or valuables of any kind. Owner reserves the right to terminate this Agreement upon their discretion at any time.

Agreement shall be enforced under the laws of the State of Alabama, including any applicable rental acts of that state, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in Baldwin County, Alabama.  If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement. Owner shall conduct all brokerage activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any Guest.
